Q. How do I speak to an MDinaBOXtm doctor on a land line?
A. Contact us via email and we will coordinate the telephone conference. Because international rates vary, the cost per minute will be based upon market value. Our doctors will call you at a prearranged time. If you think the conversation is going to last one hour, but could go two, purchase two hours worth of long distance charges in addition to the doctor's time. You can save any left over phone credits you did not use towards your next conference with an MDinaBOXtm doctor. Our doctor will then call you at the phone number you provide. Please have a second number available just in case. Email us several dates and times you are available during the day and we will email you back a date and time for the conference. The best times for our doctors are usually between 8 A.m and noon, Eastern Standard Time. (This is their evening)
Q. How to I have an MDinaBOXtm doctor attend depositions or trials?
A. There are currently two ways this can be accomplished.
1. You can have a doctor listen in via the internet using Skype, a free download. Downside: The internet can be unstable. If, for some reason, the internet goes down at your end or at our doctor's end, you lose connection.
2. The second way a doctor can listen to a deposition or trial is to call you on your cell phone and be placed on speaker phone. Then, you can communicate with the doctor via instant messaging on your laptop (make sure your laptop has internet access). It is safer for our doctors to call you on a land line or your cell phone which you can then put on speaker mode. Some software is less reliable for listening through the internet than it is for instant messaging. Instant messaging has generally been more stable and reliable.
3. If you chose to do this via telephone or cell phone, many cell phone plans will not let you call the doctor in another country. Therefore:
Remember:1. BRING YOUR PHONE CHARGER. Your cell phone battery probably would not last the length of the deposition/trial.
2. Pre-purchase enough long distance time in advance. If you think the deposition is going to last one hour but could go two, purchase two hours. You can save the time you did not use towards your next conference with an MDinaBOXtm doctor. Our doctor will call you at the number you provide. Please have a second number available just in case.
Q. What if the other side objects to the MDinaBOXtm doctor being present via the internet at the deposition?
A. This has happened on a number of occasions and at least in one case a judge was obtained on an emergency basis and ruled that since the lawyer could have a non-testifying expert sitting next to him or her during the deposition, there is no prohibition to the expert attending through internet. This technology is so new that states have not adopted rules, regulations, or laws that preclude its use. This is essentially no different than a law clerk sitting next to you helping you look up cases, etc. However, we have been told by some attorneys that certain judges/states will not permit the attendance of a non-testifying expert via phone or internet. Before you purchase this particular service, check your local rules of procedure. In any case, we suggest that you provide written notice to opposing counsel as a courtesy and to ensure your chances of prevailing on this issue before a judge. Be clear in your notice. We suggest serving a subpoena and copying opposing counsel with a notice that reflects you will have non testifying medical doctor attending the deposition via phone or internet and communicating with you privately. That way the opposing attorney can file any motions objecting to same with the court before the deposition rather than canceling the deposition at the last minute. If you want to have the doctor in India view the doctor in the U.S. or Europe, make sure you indicate that you will be broadcasting the deposition via video to your expert in the notice as well.
Q. What if the Internet is down when my MDinaBOXtm doctor is listening to the deposition?
A. Just in case, we suggest that you contact your doctor ahead of the deposition or trial and provide him with the number of your cell phone so that he or she can call in and listen to the testimony via cell phone. Thereafter, if you need to and the internet is still down, he can communicate with you during the break by phone.
Q. What if the net is down at the MDinaBOXtm doctor's end?
A. We suggest the same response as above.
Q. What if the MDinaBOXtm doctor gets disconnected during a deposition?
A. Our doctors are instructed to contact you again and if that fails, they can use your cell phone.
Q. What if the MDinaBOXtm doctor doesn't show up for deposition or trial?
A. On the rare occasions where the doctor has a serious emergency on his or her end and is unable to show up and the deposition or trial you will receive a full refund.
Q. How do I contact the MDinaBOXtm doctor via internet?
A. See the tutorial links for Skype, AIM and Yahoo IM's.
Q. What if I don't like the MDinaBOXtm doctor or his advice?
A. Please tell us. We can only provide good product if we get feedback from our customers. If you are unhappy with our doctor, please send us an email to let us know why. Please try to give us as much specific information as possible so that we can do what we need to do to fix the situation.
Q. What if I do like the MDinaBOXtm doctor's advice?
A. Please tell us this as well! We want to know our doctors and their abilities better and can only do so with your help.
Q. Will my MDinaBOXtm doctor have an accent if I speak to him or her?
A. Probably. Doctors have been asked to speak slowly and concisely but if the doctor speaks too quickly and you have a hard time understanding him or her, ask the doctor to slow down.
Q. What can I ask my MDinaBOXtm doctor to do?
1. a. Review medical records.
b. Create a medical timeline for you.
2. Attend mediation and explain medical issues to opposing counsel, and/or the mediator and your client.
3. Attend depositions via the internet and suggest questions to you as the opposing doctor is testifying by instant messaging to you.
4. Attend trial and perform the same service as reflected in depositions. (If your state/judge permits this)
5. Create ERISA letters for treating doctors to sign with abstracts of articles supporting your position.
6. Research sequelae of various medical conditions for your life care planner.
7. Prepare you for weakness in your own case.
8. Sit with you as your own client is deposed via the internet.
9. Explain medical terms to you and medical conditions to you.
10. Research MRI/CT scans and other radiographic studies.
Q. How do I send you voluminous medical records?
A. Scan all pertinent medical records into a word, text or pdf document. If the records consist of 25 pages or less, you can email them directly to info@MDinaBOX.com.
If the records are more than 25 pages, go to yousendit.com. Follow the instructions to set up a free account. Send the medical records to info@MDinaBOX.com through the yousendit.com site. This site works for any type of large files that you may have and you can use your account for other cases as well.
Q. What if I don't have a scanner?
A. If you don't have a scanner, contact a local printer. Most will agree to scan OCR for .05 - .0l per page and give you a CD or a DVD of the material. Why do you want it OCR'd (Optical Character Recognition) rather than simple scan? Because you can then send it to your own experts that way rather than making hard copies and mailing them, which can be quite expensive. However, even more importantly, you can go into the document and do a word search.
Let's say you want to find the first documentation of the word "spasm". Just go into the document, click on the binoculars icon and type the word "spasm" in the search block. The document will then show you where the first mention of that word is found.
Caveat: this does not work with handwritten notes nor does it work well with notes that are smudged or illegible.
